Dad beat autistic son Joe Clyde Daniels to death, hid his body in remote area: affidavit

Violent details have been released in the murder of 5-year-old Joe Clyde Daniels.

According to an affidavit, Joe's father, Joseph Ray Daniels, confessed to police that he beat his non-verbal, autistic son to death at their Dickson home on April 4.

Daniels told police that he "struck his son...repeatedly in the body, upper torso, head, and face with closed-fist until his son was deceased," the affidavit says.

Young Joe Clyde died at his residence along Garners Creek Road. Daniels told authorities he put the kindergartner's body in the truck of his car and "disposed" of his son's body in a remote, rural area. As of Monday morning, Joe Clyde's body still hasn't been found after authorities searched through the weekend.

Daniels called 911 to report his son missing.

It's one of a couple of new developments in the case. Joseph Daniels is currently charged with homicide in the death of his son -- mostly based on a confession that Joseph has since recanted.

Could the Innocence Project have an interest in Joe Clyde Daniels case?​

Joe Clyde Daniels disappeared five years ago and his father is now serving life for murder.

But the case remains open.

Appeals are pending and now the Innocence Project may choose to look into what happened at trial.


Daniels is serving fifty-one years in prison. Now his attorneys are finally about to file their appeal citing several issues.

"We had a lot of reversible errors in the trial so he advised he wants to pursue an appeal," said Jake Lockert.

First and foremost, the defense will argue the judge made a mistake in allowing the jury to hear Daniels' confession.

"Why did I kill my son? Why did I kill my son?" cried Daniels in a video shown at trial.

Defense attorney Jake Lockert says the confession was coerced, Daniels recanted and that there was no evidence to support his claim he killed Joe Clyde.

On appeal, prosecution witnesses will be called again to look for inconsistencies ...

"Some the witnesses may testify to something different and that's what the defense is hoping," said NewsChannel 5 Legal Analyst Nick Leonardo.

Meanwhile, Lockert says the Innocence Project is watching.

He says the organization -- which looks for those wrongfully convicted -- contacted his office to say they would like to discuss Daniels' case after his appeal.

They have not responded to our request for comment.

And, Lockert says the Innocence Project has not yet decided if it will take the case.

But, if they do, the focus will be on Daniels' words used against him.

Lockert says the Innocence Project often looks at cases involving DNA evidence.

But, in the Daniels case, the issue will be on whether there was a false confession. Remember, the case is not closed because Joe Clyde's body has never been found.

There is no physical evidence.

Daniel's conviction came on the strength of witness testimony and his confession.

There is a renewed effort to learn what exactly happened to Joe Clyde Daniels. The little boy who disappeared in 2018 would have turned eleven this week.

Yes, his father is convicted of murder.

Still, the boy's body has never been found, and family members are still seeking answers.

Joe Clyde Daniels was only five when he disappeared from his Dickson County home. There was very little physical evidence, still there was a trial and conviction.

But questions remain for one simple reason: Joe Clyde's body has never been found.


But to this day Daniel's mother refuses to believe her son killed her grandson Joe Clyde because the child's remain have never been found ...

"I know they didn't find them because he's not dead," said April Collins. She maintains her son's confession which he recanted was coerced.

And now Collins and other family members hold out hope that perhaps Joe Clyde was abducted and is somewhere still alive. And if not, they simply want to locate the child's body so he can be given a proper burial.

To that end, they recently started a media campaign asking the public for tips or new leads.

"Every place we can put it out. If you can put it out do it. I want him found. I want him home," said Collins.

They have started posting fliers in public places and on social media sharing the hotline for the Tennessee Bureau of Investigation with Joe Clyde's photo.

He would have just turned eleven. The family is still seeking answers,

"I just want him back. I want him back home. I want to know where he's at."

They really get on my dam nerves. They were advocating for this man in prison. He was going to be put to death. He SWORE HE WAS INNOCENT. DNA was not in existence at the time in the case. He gave his DNA. But it wasn't I. Time to save his life. He was executed. The results came back. HE DID IT!!! This case MMO. The mother is serving 15 years for abuse. I think this all connects. These two.....

Poor little boy. I wish they would find him, So he can rest in peace. Instead of just being dumped somewhere. So all that control. Or your portrayal of being innocent isn't working.

He was convicted. Mom took the sentence for abuse. It does all connect.

I don't think on this one the innocence project is going to tryvto help an innocent man. Actually maybe there should be an innocence project that gets justice for INNOCENTS too. Ya know, like in minor children for instance.

I know such can happen, a wrongful conviction, but it is not the norm. And this man ain't one of them.

The searches, however, have since ended, with investigators saying they haven’t received any credible leads in years as to where the boy affectionately known as “Baby Joe” may be.

“There’s just no information right now to warrant a search of anywhere at this point,” stated Eads.

The child’s father, Joseph Daniels, confessed to fatally beating his son who had autism and was non-verbal. He told investigators that he then dumped his body in a rural area.

“A jury thinks he did it; they’ve convicted him of it,” Eads said, adding that Joseph should let investigators know where the boy is.

Joseph’s confession played before a jury that ultimately found the father guilty of felony murder.

“At any time, he can do the right thing. I know he’s maybe betting on appeals,” Eads said.

Appellate briefs asking for a new trial are filed, arguing that the father’s confession was coerced and was a false confession.

“We are prepared if we had to have another trial. I feel confident in the things I’ve seen and know, that I can’t speak to, that it will result in another conviction,” Eads said.

Joseph was sentenced to life in prison. The court of criminal appeals will likely make a decision later this year concerning a potential new trial.
 
It's their last control. They want everyone else to suffer. They have to be offered a plea deal. Or get something out of giving the information. Which infuriates me!!! They see it done. They are going to do it too.

It is what almost all these sick Pieces of S do. Some wouldn't give it up even for a CHANCE at ever getting out, only or something like release and God forbid we ever go there.

It's easy to say as I haven't lived it but here is what I tell myself in cases of no remains. God has them. Whether they went up in the Twin Towers and nothing was left, whether they have never been found but one knows or is pretty sure a body is out there somewhere, whether a flight went down in an ocean and remains have never been found, no matter what it is, God has them. I havent' lived it so I can't talk to it and I know people need to feel they've laid loved ones to rest and found them and have a grave to go to. But still, God has them. And that's not them, it is their physical remainder of remains. I know you are different than me and may disagree but I do NOT go and visit the graves of all the lost in our family. I have been due to reasons with someone else. For me it isn't where they are. For me I talk to them every day or in my head I do. I don't know how to put it and again I haven't lived never having remains although we did go through quite a time on teh baby but it isn't there soul, it is not where they truly rest or truly are. I think you will get me to a point because of our beliefs.

Now in a case where it is necessary to help prosecute, to have a body that is different and I SURELY do get someone needing the remains to get closure and more info on what happened and I MOST CERTAINLY GET treating the remains with some honor and doing what you last can for them after someone took them out unfairly and did not treat them right. I get all of that. But these victims are with God and in such a case or event I'd comfort myself that way. And the evil POS who wont' give it up if already in prison, well then he thinks he has more power than he does. If not convicted or needing a body to even get a case prosecuted that is a different story.

Not sure if I am making any sense but to not have a body means they are not at peace kind of means anyone who ever had a family member disintegrated or last at sea means their loved one is not at peace and with God? No, of course it does not. Imo. I went with my ome when I was there and we were doing something for the baby's grave. And while there, I had never been we went to my broehr's and dad's and I fell apart. My other brother is buried in another cemetery but still near family and in the same county.

I don't go though and hadn't. And major major hugs and praise to my sisters and mother who do and keep things up there. I just have never been one to believe that's where they are. I k now they don't either in the realm of eternal life but I truly don't. And of course I'd have as big of a problem as anyone if someone wrecked their resting place or some such.

Every single birthday or date of death or father's day or you name it is huge on me every single year as I KNOW you identify with and all do. But I don't need to be att the grave site to honor them or talk to them in my head or to God although there is total understanding from me in doing so, and I have and would too. And sometimes I feel their presence and I am nowhere near where they were laid to rest.

Not sure I am making sense but for some reason I think you will get me. I so would fight and I havt these evil Pieces of that won't give up a body location and I DO GET the family needing it. I do. I would fight tooth and nail for it and the right to give my loved one a kind and right laying to rest and time for family to no end.

I would however comfort myself in knowing no matter what happened, natural, murder or otherwise, they are with God and where their bones lay is not where they are.

Probably a way off the norm kind of post and not typical response to this but if it helps even one person who doesn't get their loved one back, I think it worth it.

Sure I know where mine lie but I also don't need the place to honor or visit them as they are most definitely are not there. They are elsewhere and on occasion they are with us still. They are always WITH US but what I mean is when they make their presence known and you know they are REALLY with you.

Okay, call me out. As an off the wall kind of response lol. However, I truly believe every word of it and it is how I I would find comfort if ever we did not have the remains or know where they were after being upset to no end and I would pursue forever the chance of getting themand want them fond, do not get me WRONG, I WOULD. To have answers, to lay to rest and treat them with respect after someone else not doing so and so on. But if it never happened, I would comfort self believing this. And I would never ever ever let someone out or make a deal as a family member to have them return or point the remains. It would be tough but I woudln't ever let a monster back on the street to do it to someone else's loved one. Because God has them.

So to come back to a more normal plane, yeah he can hold his last bit of control and hope to be a free man YEAH RIGHT. If in his shoes, trade the info for a Snickers bar you dumbarse because if anyone ever deals for more than that or a lightening of your sentence, or release, then the system is so far gone it is unrecoverable.

I know, I know, a diatribe not expected. I've had a lot of loss and I know what comforts me and has barely gotten me through. And it is such beliefs.

I don't think my loved ones are ever in the cemetery unless maybe one of us are there and they know the need. And I'm not one that's there. But I for sure have had them around. I need to go back to a long unposted in thread of stuff about this that was quite a thread. Tracker was really on it a lot and we have no idea to this day do we or does anyone what happened to him?

I am way off I guess this being about Joe but it is. He is a child and he is with God. I doubt the pieces of filth around him ever will be. But I'm not the judge of that.

Daniels had recanted before trial, and there was no evidence to support his original claim that he killed Joe Clyde. Lockert says the Innocence Project expressed an interest in the case.

He says the organization, which looks for those wrongfully convicted, had contacted his office to say they would like to discuss Daniels' case.

The Innocence Project did not respond to our request for comment. Lockert says the organization has not yet decided if it will take the case.

It's possible they will still wait to see if the state Supreme Court agrees to hear the case.

Lockert says that's a long shot.

But he believes there's video proof the confession was coerced and without it Daniels never would have been convicted.
 
Most think the Innocence Project is a great thing, a non profit and does good. Well I don't. There are things about it, the LA for instance in particular that I don't find very above board AT ALL.

People are entitled to their opinion but I'd caution in thinking it's all great and all above board because imo it's not.

What is the harm of them looking into it? They don't just say everybody is innocent when they do look into them. It never hurts to put fresh eyes on any case.

Let them go for it. I'm just saying for me they aren't simply what they appear to be. AND there's several of them.
