Dad beat autistic son Joe Clyde Daniels to death, hid his body in remote area: affidavit

Violent details have been released in the murder of 5-year-old Joe Clyde Daniels.

According to an affidavit, Joe's father, Joseph Ray Daniels, confessed to police that he beat his non-verbal, autistic son to death at their Dickson home on April 4.

Daniels told police that he "struck his son...repeatedly in the body, upper torso, head, and face with closed-fist until his son was deceased," the affidavit says.

Young Joe Clyde died at his residence along Garners Creek Road. Daniels told authorities he put the kindergartner's body in the truck of his car and "disposed" of his son's body in a remote, rural area. As of Monday morning, Joe Clyde's body still hasn't been found after authorities searched through the weekend.

Daniels called 911 to report his son missing.

It's one of a couple of new developments in the case. Joseph Daniels is currently charged with homicide in the death of his son -- mostly based on a confession that Joseph has since recanted.

Autism spectrum disorder and sleep

Like all children, children with autism spectrum disorder (ASD) can have trouble getting to sleep and staying asleep.

Children with ASD can also have sleep problems that we don’t see as often in other children. These difficulties include:

  • irregular sleeping and waking patterns – for example, lying awake until very late or waking very early in the morning
  • sleeping much less than expected for their age, or being awake for more than an hour during the night
  • getting up and playing or making noise for one or more hours during the night
  • excessive sleepiness during the day.
On another note, I followed this case (on another website) from the day this baby was reported missing, and in my opinion and for whatever that is worth - I have never believed he was abducted or kidnapped. I believe his father's recanted confession is the absolute truth of what happened to baby Joe Clyde.

I would love to be proven wrong.

As do I. BOTH parents gave a similar confession (Joseph said he hit him repeatedly until he was deceased, Krystal said she saw Joseph standing over Joe's body). They both later recanted...

But I do have some questions. Maybe somebody can help fill in some gaps?

Joseph said that after he killed baby Joe, he put him in the trunk of his car and hid his body. However, security cameras seemed to show that his car never moved that night. So where is baby Joe? How did he dispose of him? Is he really still on their property and hasn't been located? Yes there is some wooded area, but the immediate property area is not THAT big... And yet his blanket was (possibly) located several miles away?

I could be wrong, but I don't get the impression that the Daniels' were particularly "well off" financially. Are they really going to drop money on a sleep study (depending on insurance, can be several hundred to several thousand $$$)?? Or was this simply a last-ditch effort as they were so utterly tired and frustrated with baby Joe?

Baby Joe was said to wake often in the night and had even been found outside several times. A witness supposedly saw a child out in/near the road that morning. Is it really that far off-base that he could have wandered away?

To be clear, I am not advocating for Joseph/Krystals' innocence necessarily. I just think the prosecution still has several gaps to fill in if they're going to win this case. Finding baby Joe would be a big step.

But having a child that is up and down thru the night and getting outside could make someone snap. I'd like to know where he is tho.
 
Another question I just thought of. Haven't seen it mentioned unless I missed it, which is possible. Did they ever TEST the trunk of his car to see if human remains (or blood, etc.) was detected? Would be a key piece of evidence if Joe is found in another location, IMO.

There was a search back in June...they found bone and bone fragments. I don't believe those have been officially identified? Attorney said they were from "pets" but never heard anything official... Could be be possible that his partial remains have already been located?

True. But even if "ordered" by CPS or a doc there is still going to be a cost. But depending on insurance it could be not much, or it could be thousands... If they had Medicare / Medicaid or a good private insurance, along with a doctor's orders, it may have been fully or mostly covered.

Absolutely. Sleep deprivation can make people do crazy things. (Also not saying it's an excuse.)

Joe Clyde was five-years-old when he disappeared from his home on April 4, 2018. He would now be 8-years-old.

Joe Clyde’s grandparents said they are holding out hope that the child is still alive and began circulating a flyer with the images which also offers a $30,000 reward.

Key evidence leaked in violation of gag order in Joe Clyde Daniels case​


Someone has illegally leaked key evidence in the high-profile Joe Clyde Daniels case in Dickson County. The presiding judge wants to know who and if he finds out it could mean jail time.

Obviously, there's been an awful lot of publicity on this case over the past two years. But with a trial scheduled for early next year, Judge David Wolfe issued a gag order several weeks ago.


In recent weeks, someone with access to the discovery file has been posting online or sending evidence from the criminal case to the media -- in blatant violation of the gag order.

"The person who has done that could be held in contempt of court and sentenced to jail," said legal analyst Nick Leonardo.

So, what type of evidence? Video clips.

One video shows Joe Clyde and his father participating in a sleep study -- making the case that the boy rarely slept through the night and that he may have wandered off the night he disappeared. Another video clip shows authorities questioning someone in connection with the case.

The judge has taken notice and issued a show cause order. Leonardo says all the lawyers will be put under oath.


It's worth noting most of what's been leaked seems to be a benefit to the defense.

The judge just wants to make sure everyone involved gets a fair shake come trial. Joseph Daniels and Krystal Daniels are scheduled to go to trial together in Dickson County next February.
 

Intern in public defender's office fired after evidence leak in Joe Clyde Daniels case​

For now, no one will be held in contempt of court following an evidence leak in the Joe Clyde Daniels case.

Judge David Wolfe issued a gag order several weeks ago. No judge likes to have his order ignored — especially in such a high-profile case.

In a hearing Monday afternoon, attorneys revealed that the leak came from a paid intern in the public defender's office. That intern has since been fired.
 

Joe Clyde Daniels case: Private investigator believes boy could have been abducted or hit by car​

A private investigator – who's worked on numerous missing persons cases, including the Joe Clyde Daniels disappearance – believes the boy could have been hit by a car or was possibly abducted.

The child’s body has never been found, and there is little or no physical evidence. A gag order was issued earlier this year, so no one associated with the case can talk publicly about it.

However, David Marshburn, a private investigator out of North Carolina, is not bound by the gag order. He met with Joe Clyde’s grandparents last year and used his blood hounds to search for the boy’s remains. He also closely followed the case just last week in Cheatham County where nine-year-old Jorden Gorman was found safe two days after he disappeared from his Ashland City home.

Marshburn says that highlights just how easy it is for a small child to walk away and vanish. However, authorities continue to maintain that the parents were involved in Joe Clyde’s death.

But Marshburn says he now believes there’s evidence that will surface that Joe Clyde was either hit by a car and taken away or abducted the night he disappeared.

"That is a possibility, but the greatest possibility is him getting hit by a vehicle," Marshburn said.

In the absence of a body, Marshburn says that is the most plausible explanation, and with time, other suspects will surface. For now, it's only a theory.

"How many people have been out looking for Joe Clyde soon as he went missing," asks Marshburn. "And, what have we found? Absolutely nothing."

At one point, Marshburn believed the parents were involved. After all, the father confessed to beating the child to death before recanting. Defense attorneys have argued there's no evidence to back the confession -- and no blood found on any item in the house or anywhere on the property.

However, prosecutors do say they have evidence to convict the parents.

The Daniels case was supposed to go to trial in spring 2021, but due to COVID-19, that won’t happen. The Tennessee Supreme Court has shut down all jury trials because of the pandemic. This means the Joe Clyde Daniels trial will likely be pushed back until at least next summer – more than three years after he went missing.
 

Trials shutdown likely to delay Daniels case​

A Tennessee Supreme Court order suspending jury trials for two months likely will delay the Dickson County case involving Joe Clyde Daniels.

The boy’s parents, Joseph and Krystal Daniels, are scheduled for trial in February, but the state supreme court’s order extends the suspension of jury trials through March 31 on account of the COVID-19 pandemic.

The Jan. 15 order allows for Chief Justice Jeffrey Bivens to make exceptions to the suspension on a case-by-case basis, so it is not certain how jury trials in Dickson County courts will be affected.
 
Going to be an interesting trial to watch.


Trial of father accused of killing 5-year-old Joe Clyde Daniels to start in June​

The trial of Joseph Daniels, who is accused of killing his son, has been set to start in June.

Another in-person hearing is scheduled for April 1. The trial date is set to start June 1 and would finish by June 11.

In a case with very little physical evidence, a witness’ statement can be all the jury needs to convict.

In the case against Krystal Daniels, what she claims she saw could help put her husband behind bars for life or face the death penalty.

Tennessee Bureau of Investigation’s Special Agent Joey Boyd has been the lead case agent on the investigation into missing – but presumed dead – Joe Clyde Daniels, also known as Baby Joe.

Krystal Daniels faces aggravated child neglect charges in the case of her missing son.

In the early morning hours of April 4, 2018, Boyd testified that Joseph and Krystal claimed their son Alex woke them with news about his 5-year-old brother.

“Joe Clyde had urinated on the floor. Joseph said that he’d handle it,” said Boyd.

In her statement to investigators, Krystal said a loud scream followed.

“She described it as a painful scream, and then she described that it suddenly just stopped. And, it was silence,” recalled Boyd.

Krystal came out of her room to find Joe Clyde on the ground.

“Motionless. Not moving. And Joseph standing over him with his fists clinched,” said Special Agent Boyd.

Krystal said her husband, who apparently has a black belt in martial arts, took a swing at her and said if she told anybody, he’d kill her.

“She stated that she never got close enough to check on him.” Boyd testified, “She went back to her room. She heard the car door shut. She came out of the room saw that Joseph and Joe Clyde were gone. She said she went back to her room and went to sleep.”

In the following days, Krystal and Joseph continued to claim Baby Joe had run off.
 

Judge rules Joe Clyde Daniels’ parents will be tried separately​

A judge ruled Thursday morning the trials for Joseph and Krystal Daniels in the disappearance of their 5-year-old son Joe Clyde will be held separately.

Circuit Court Judge David D. Wolfe ruled that Joseph Daniels’ trial will begin on June 1. The trial date for Krystal Daniels will be set at a later date.
 
IMO Krystal Daniels is grossly undercharged. I understand they need her testimony against Joseph but Aggravated child neglect is ridiculous. At the very least, she heard him kill poor Joe Clyde & leave, then rolled over & went back to sleep.
 
If her statements won't be used...why try the cases separately?

Attorneys will also not be using statements his mother, Krystal Daniels, made after her arrest in the trial.

Phone call: Joseph Daniels implicates wife Krystal in Baby Joe’s death​

A new and contradicting statement by Joseph Daniels revealed in court Tuesday as testimony was heard in a motion to reduce his bond.

In a phone call that was played, Joseph Daniels implicated that his wife, Krystal, killed Joe Clyde Daniels – their five-year-old boy who they reported missing three years ago.

Joseph Daniels made the call from jail to his father, Joe Clyde Daniels Jr. on July 1, 2019. That was 16 months after he was charged with criminal homicide in the murder of Baby Joe.



At first the two exchanged small talk about things like the weather. But then, the call turned more sinister. Joseph Daniels started to talk Baby Joe. The grandfather, Joe, did not bring up the case or prompt him to talk about it.

At one point Joseph Daniels said, “I’m not telling the whole story either yet. You’ll find out later.”


Joe followed that statement with the question, “Who all did she threaten you with?”

Joseph Daniels answered, “She [Krystal] did what she did, and she threatened me with a knife and told me if I told anybody that she could have people to do it.” He added, “It was too late, it was too late, I pushed her off of him.”

Joe asked, “Pushed her off who?” Joseph Daniels answered, “Joe.”

During that phone call, Joseph Daniels said that Krystal used a pillow to kill Baby Joe. He also insinuated that ‘she washed away the evidence’. He also claimed that she was wearing his hoodie.

When asked if she said why she did it, Joseph Daniels responded, “No,” and added, “All I know is she threatened to kill me after it happened.”

“She took took the baby’s life away, but where he went, she’ll never go there,” Joe said.

Joseph Daniels responded, “Especially, a special needs child.”

“Special needs or not, you don’t kill your baby,” Joe exclaimed.

District Attorney General Ray Crouch followed the phone call with a series of questions for Joe. At times Judge David Wolfe had to ask him to directly answer the question.

AG Crouch asked, “Mr. Daniels, in April of 2018, you sat in a vehicle with your son and [TBI] Agent Brandt Holt, correct?”

Joe answered, “Yes.”

AG Crouch continued, “While you were in that vehicle, your son admitted to you that he had beat and killed Baby Joe.”

Joe responded, “Yes.” He also claimed that his son was coerced into admitting guilt. “Y’all had made him feel the way he felt.”
 

Judge denies bid to lower Joseph Daniels’ bond​

A judge has denied a motion to lower Joseph Daniels’ $1 million bond in the case involving the 2018 disappearance of the defendant’s son, Joe Clyde Daniels, when the autistic boy was 5.

More hearings are set for May 12-14, Wolfe said. Joseph and Krystal Daniels will be tried separately, under an April 1 decision by Wolfe, and both trials are slated for June, with the boy’s father up first.


The jury in the Joseph Daniels trial will be sequestered, Wolfe said. He did not elaborate, but typically that means jurors will stay at a hotel with restrictions on whom they can contact and what media they can access.
 

New key witness in Joe Clyde Daniels case surfaces just weeks before trial begins​


A stunning new development in the Joe Clyde Daniels murder case - just weeks before trial is set to begin, a crucial new witness has surfaced.

She will be under subpoena and her testimony will raise new questions about what happened to the missing little boy.

It's been three years, and you may ask: A key, new witness surfaces only now? How does that happen?

Well, this lead appears to have been buried under the reams of evidence collected in the case.

"This witness is very significant," said Jake Lockert, the lawyer for Joe Clyde's father.

He said there is a potential second witness who saw Joe Clyde alive.

"Yeah, she will be subpoenaed to testify in the case," said Lockert.

Until then, her name is not public.



Authorities confirm a single witness - a passing motorist - reported seeing a small child walking alone on Garner's Creek Road the night Joe Clyde disappeared.

If it was Joe Clyde, some allege the father chased him down and brought the boy back into the home.

But now this new development:

"We find a lady whose child, within a day or two, came in to say there is a little boy out front in dirty pajamas," said Lockert.

Could this be a second witness to see the child in the hours after he disappeared?

Lockert only recently found the report filed with the Humphreys County sheriff three years ago.

A woman called to say her 5-year-old daughter was outside the day or two after Joe Clyde disappeared and encountered a small boy. The little girl said she spoke with the boy and only later mentioned his odd responses to her mother.

"She asked him what his name was and he said five," said Lockert. "Those aren't logical responses, but you essentially have an autistic child who is nonverbal."

Joe Clyde's grandfather said the boy often referred to himself as five, his age, instead of using his name.

If this was Joe Clyde- it means he wandered some 6 miles overnight and then was spotted hours later before disappearing again.

"It is significant because it shows the child was alive after the time period where my client said he killed the child," said Lockert.
