Bernard Madoff says he is dying and is asking a judge for compassionate release from prison, where he is serving 150 years for orchestrating the largest Ponzi scheme in history, according to a Wednesday federal court filing.

Madoff, 81, has terminal kidney failure and a life expectancy of less than 18 months. When the court sentenced him, “it was clear that Madoff’s 150-year prison sentence was symbolic for three reasons: retribution, deterrence, and for the victims,” the court filing states. “This Court must now consider whether keeping Madoff incarcerated … is truly in furtherance of statutory sentencing goals and our society’s value and understanding of compassion.”

Madoff said in the request for compassionate release that he “does not dispute the severity of his crimes.”

Alec Baldwin and armorer Hannah Gutierrez-Reed will face criminal charges for the October 21, 2021 fatal shooting of Rust cinematographer Halyna Hutchins, the Santa Fe District Attorney said this morning.

Close to 16 months after Baldwin took the life of Hutchins and wounded the movie’s director Joel Souza with a loaded gun on the set of indie western Rust, New Mexico First Judicial District Attorney Mary Carmack-Altwies today has finally unveiled her decision as to who should be charged and not charged in the tragic incident.

“After a thorough review of the evidence and the laws of the state of New Mexico, I have determined that there is sufficient evidence to file criminal charges against Alec Baldwin and other members of the ‘Rust’ film crew,” Carmack-Altwies said Thursday. “On my watch, no one is above the law, and everyone deserves justice.”

In charges set to be formally filed by the end of the month, Baldwin and Gutierrez-Reed will each be charged with two counts of involuntary manslaughter in Hutchins’ death.

“If any one of these three people—Alec Baldwin, Hannah Gutierrez-Reed or David Halls—had done their job, Halyna Hutchins would be alive today. It’s that simple,” stated Andrea Reeb, the special prosecutor assigned to the case. “The evidence clearly shows a pattern of criminal disregard for safety on the ‘Rust’ film set. In New Mexico, there is no room for film sets that don’t take our state’s commitment to gun safety and public safety seriously,” Reeb added.

ALEC BALDWIN WAS charged Thursday with involuntary manslaughter in connection to the fatal shooting of cinematographer Halyna Hutchins on the set of the film Rust last year.

Following a lengthy investigation, the New Mexico First Judicial District Attorney’s Office announced charges stemming from the Oct. 2021 shooting on Thursday. In addition to Baldwin, the film’s armorer Hannah Gutierrez-Reed will also face involuntary manslaughter charges, while first assistant director David Halls was hit with a negligent use of a deadly weapon charge; Halls has already agreed to plea guilty to that count.

Since there's going to be a trial, we should probably make a thread for this.

A Texas community hit by terrible tragedy months ago came together over the weekend to celebrate a survivor's first birthday.

Paul Gilbert Anchondo was two months old when his parents died shielding him from a shooter at an El Paso, Texas, Walmart on August 3, 2019.

Over the weekend, the toddler turned 1, CNN affiliate KVIA reported, and hundreds of residents drove in a parade to celebrate the boy.

They wanted to remind him "he's not by himself," Gilbert Anchondo, the baby's grandfather, told the news station.

"We want him to remember that everybody here in the El Paso area and our community is supporting him," he said.

The man accused of killing nearly two dozen people in a racist attack at an El Paso Walmart plans to plead guilty to federal charges in the case, according to court records filed days after the federal government said it wouldn't seek the death penalty in the case.

Patrick Crusius is still charged in state court with capital murder, and could still face the death penalty in Texas if convicted in the 2019 mass shooting that killed 23 people.

In a court filing Saturday, defense attorneys asked for a hearing to be set so Crusius could plead guilty to federal charges. He was charged with federal hate crimes and firearms violations.

U.S. District Judge David Guaderrama, in an order Monday, set the hearing for Feb. 8 in El Paso.

Crusius surrendered to police after the attack, saying, "I'm the shooter," and that he was targeting Mexican people, according to an arrest warrant. Prosecutors have said he published a screed online shortly before the shooting that said it was "in response to the Hispanic invasion of Texas."

CHICAGO -- A state appeals court on Monday granted a request by Jussie Smollett's defense lawyers for a fifth extension to file their initial argument, but warned it would be the last time.

"A fifth motion for more time to file an opening brief, particularly by the defendant in a criminal matter, is rare," the three-judge panel of the First District Appellate Court wrote in its order. "Nevertheless, the court grants the motion to serve and file appellant's brief on or before March 1, 2023. After that date, no further extension will be granted."

In their motion last week for yet another extension, Smollett's attorneys said their brief was completed and, at the time, they were still waiting for a ruling on a request to file an oversized brief in the case.

In the ruling Tuesday, the judges allowed Smollett to file an oversized brief but not as large as they had requested. "Instead, Defendant-Appellant may file a brief not to exceed 20,000 words, a 33% increase in the number of words," the court ruled.

MANCHESTER, N.H. —
In less than two weeks, the New Hampshire Supreme Court will look at a case involving Pamela Smart.

She has served more than 30 years in prison for her role in the 1990 shooting death of her husband Gregg Smart.

The state's highest court will hear oral arguments on Feb. 14 over Smart's right to get a hearing on a petition for commutation.

Her previous requests have been denied by Gov. Chris Sununu and the New Hampshire Executive Council.

Over four months after the hearing that overturned Adnan Syed’s murder conviction in the 1999 killing of Woodlawn High School classmate Hae Min Lee, the Appellate Court of Maryland heard arguments this morning in an appeal from Lee’s brother that could set a precedent for victims across the criminal justice system. A ruling on whether Young Lee received adequate notice of proceedings and an opportunity to meaningfully participate is expected in the coming weeks or months.

A 15-year-old was arrested on Jan. 28 driving a vehicle associated with one of three missing rappers last seen last month in Detroit, authorities say.

The juvenile was in possession of Armani Kelly's vehicle, according to CBS Detroit. Kelly and two others — Montoya Givens and Dante Wicker — went missing on the night of Jan. 21. The three men were supposed to perform at Lounge 31 in Detroit, but the show was canceled.

"I can tell you that there was a juvenile that was arrested, not in connection with the missing people, but in connection with a vehicle associated with one of the missing people," Dawn Fraylick, communications director for the Macomb County Prosecutor's Office, told CBS News.
