I hate it when they deny justice and answers by such measures. Not much sympathy for him though, assuming he did the things alleged anyhow...

It's also just something else for this poor boy to deal with. It may relieve him or it may well give him very mixed feelings.

I would be ecstatic, if I were him. Good riddance. He can never be released to do more harm now. No getting released from technicalities, which would be even worse to deal with..

I agree but guess it depends on how long he's been around too and if he was ever good to him at ALL. Probably not. Kids have mixed feelings sometimes, they hate such an abuser for good reason but also often love them. That's all I mean by such.

Overall I agree with you, he is probably relieved although maybe he wanted him to suffer and spend life in prison.

I however am GLAD he is gone, not just for the money savings but because they let so many back out these days. There was no death here, so there was a good chance and with a defense that one day he might have been freed. I wouldn't have mind him suffering though either...

Legal analyst explains impact of defendant’s death in Chickasha child abuse case

But legal analyst, criminal defense attorney, and former prosecutor Ed Blau explained how a situation of this type might play out.

“In most cases, if there’s a death of a codefendant, unless there was some need for that codefendant to possibly flip and testify against the other person, generally, if there’s enough evidence to prosecute one, there’s enough evidence to prosecute the other,” Blau said.

In the case of Kimberly and George Cole, both were charged separately and not as codefendants.

Without knowing exactly what kind of evidence prosecutors have against Kimberly, Blau said there’s still a relatively straightforward path for prosecutors despite George’s death.

“In any case involving a child, if the prosecution has to rely solely on the child’s testimony — that can sometimes be difficult,” he said. “However, if there’s other evidence, if there’s photographic evidence, if there are other witnesses, if there are other things out there that show that it’s likely the defendant committed the crime, then the prosecution’s job is a lot easier.”

Kimberly Cole, the biological mother of a child who went missing from his home in Chickasha and sparked a county-wide search.

Investigators soon determined that the boy was attempting to escape a life of abuse.

Kimberly Cole has been charged with three counts of child abuse, two counts of child sexual abuse, three counts of child neglect, one count of conspiracy, and two counts of crimes against nature.

The boy's stepfather, George Cole, was charged with eight counts of child abuse, one count of child sexual abuse, three counts of child neglect, one count of pattern of criminal offenses, and one count of conspiracy.

However, he died after being taken off of life support after a suicide attempt in jail.

On Thursday, Kimberly Cole is expected in court for a preliminary hearing conference in Caddo County.
