Amber Alert issued for missing 14-year-old girl and man tied to infant death case​

An Amber Alert has been issued by the California Highway Patrol connected to a case of a dead infant found north of Moss Landing.

The alert was put out at the request of the Monterey County Sheriff's Office.

They're searching for Sergio Galvez Perez, who has been charged with 3 felony counts by the Monterey County District Attorney’s Office.

This is in connection to the alleged rape and kidnapping of his own daughter.

His daughter was named in the Amber Alert as the kidnapping victim.

Her name is Diana Galvez Ortega.

The alert says she was abducted on Aug. 4.

Newborn baby found dead on roadside, California man and 14-year-old daughter wanted by authorities​

Authorities are searching for a California man and his 14-year-old daughter after a newborn baby was found dead on a roadside in a rural area.

The Monterey County Sheriff’s Office said the 14-year-old girl is believed to be the infant’s mother and her father, Sergio Galvez Perez, 38, is wanted for incest and child sex crimes.

Authorities confirmed that the father and teen are believed to be the baby’s biological parents.

On Aug. 1, authorities responded to reports of a baby girl found unresponsive on the 100 block of Struve Road in Monterey County around 8:30 a.m. The baby was pronounced dead at the scene.

Following an investigation, detectives believe the 14-year-old girl gave birth to the baby along the side of the road and left her on the ground before fleeing the area.

A forensic examination conducted on the baby, whom authorities have named “Baby Angelita,” indicated she had signs of traumatic injury.


At an Aug. 31 press conference, Monterey County Sheriff Tina Nieto said the department could only provide limited details, considering the case involved two juveniles and that the 14-year-old girl was a victim of sexual abuse.

“At the center of this [case] is two children — Baby Angelita, who lost her life, and a 14-year-old child who is now the subject of a series of allegations involving the death of a baby and who is also a victim because of the sexual abuse by her own father, ” Nieto said.

Perez is wanted for multiple felony violations including incest, lewd or lascivious acts with a child younger than 14, lewd acts with a minor, unlawful sexual intercourse, child concealment and child endangerment.

The 14-year-old girl’s mother, Ofelia Garcia Ortega, 36, of Castroville/Salinas, was also arrested for child endangerment.
 
They really need to get their $hit together. This girl was raped and impregnated by her father at age 13. She is clearly abused. I highly doubt she made the decision to leave the baby behind by herself. They make such contradicting statements saying that she is a victim but they also put out a warrant for her arrest...

Alleged incestuous father charged; no decision on child rape victim in newborn’s death, DA says​

The search continues for a man who is alleged to have sexually abused and impregnated his daughter at 13, resulting in her giving birth on the side of the road near a strawberry field in northern Monterey County.

The story has garnered national attention for the horrific details of the rape of a child at the hands of her allegedly incestuous father and, secondly, for the Monterey County Sheriff’s Office seeking the 14-year-old daughter for the murder of her newborn, who herself is a victim in this case after allegedly being sexually assaulted by her father.

The sheriff’s office has emphasized that the 14-year-old is a child and a victim of sexual abuse by her father. At the same time, investigators are seeking her in connection with the death of her newborn daughter, and a warrant has been issued for her arrest for murder.

“At the center of this are two children: Baby Angelita, who lost her life, and a 14-year-old child who is now the subject of serious allegations involving the death of the baby, who is also a victim because of the sexual abuse by her own father,” Monterey County Sheriff Tina Nieto said.

Authorities identified Sergio Galvez Perez, 38, as the girl’s biological father and Baby Angelita’s biological father. He is being sought on felony warrants alleging incest, lewd acts with a child under 14, lewd acts with a minor, unlawful sexual intercourse, child concealment and child endangerment.

Monterey County Sheriff Tina Nieto said Galvez Perez is believed to be concealing the 14-year-old and preventing law enforcement from locating her. Her name has not been released because she is a juvenile.

According to SFGATE, a Monterey County Sheriff’s Office spokesperson said the family has ties to Tierra Blanca in the Mexican state of Guerrero. Investigators believe Perez and the child could still be in the Castroville or Salinas area, elsewhere in the United States, or may have fled to Mexico.

Nieto urged Galvez Perez to turn himself in.

“We need to find this 14-year-old child,” Nieto said. “We need Sergio Galvez Perez to stop hiding and face the charges against him.”

The sheriff’s office obtained a Ramey warrant for the teen. A Ramey warrant is issued by a judge based on probable cause and is sought by law enforcement. The spokesperson said the facts of the case led investigators to seek the warrant but declined to release additional details.

A warrant authorizes law enforcement to take someone into custody, but it does not establish guilt or mean prosecutors will ultimately file charges. The Monterey County District Attorney’s Office will determine whether there is enough evidence to prosecute the teen for the newborn’s death.

The Monterey County District Attorney’s Office clarified on Wednesday that it has not received a filing request or investigative reports concerning the 14-year-old girl. As a result, the office has not made a charging decision regarding the teen.


“We recognize that the 14-year-old is a victim of her father’s abuse. No child should ever have to endure such horrific circumstances,” the DA’s Office said in a statement.

The office said children who experience abuse can face extraordinary barriers to safety, particularly when they are under the control or influence of an abuser. It said responsibility for getting the girl to safety does not rest on her and that victim advocates and partner agencies are prepared to provide her with support and services if she is located.


SFGATE reported that detectives found four other children living in the family home under conditions they considered unsafe.

Authorities have not said whether the four other children were removed from the home. It also remains unclear whether the 14-year-old or her siblings were enrolled in school, whether she continued attending classes while pregnant, or whether Monterey County Family and Children’s Services had previously received reports about the household.

SFGATE reported that it contacted the county Department of Social Services for answers but had not received a response by publication time.


“I believe the 14-year-old might be in danger. That’s my gut feeling as a sheriff,” Nieto said. “She’s 14, for God’s sake. She’s 14. She’s a victim, too, even though she’s a suspect.”
 
That's the one where I was questioning how they are charging her with murder and his do they know the father didn't? He had the most to lose with the baby being born.
