Event at Fort Monroe celebrates Codi Bigsby's 7th birthday

Memorializing Codi Bigsby.

That was the goal of friends and family gathering at Fort Monroe Sunday.

Not only did Sunday's event celebrate Codi's birthday, but it also praised the implementation of the CODI Alert which Gov. Glenn Youngkin signed in Spring 2024.

Codi Bigsby case: How the missing case unfolded, 3 years later

Friday marks three years since 4-year-old Codi Bigsby was reported missing by his father in Hampton in a case that captured the attention of Hampton Roads.

Codi's body has never been found.

The case isn't over: Bigsby faces 30 more child abuse charges with a trial set to begin Tuesday. He could receive another 162 years on those charges.

Prosecutors won't pursue Bigsby abuse charges following murder conviction — for now: Docs

Prosecutors in Hampton are asking the commonwealth to "noelle prosque" child abuse and neglect charges against Cory Bigsby more than a year after he was convicted of murdering his son Codi.

This is all according to a motion filed by the commonwealth that Bigsby's attorney, Amina Matheny-Willard sent to WTKR News 3.

Last March, a jury found him guilty of killing his son, Codi Bigsby, in 2021 or 2022. He is currently serving a 45-year sentence for second-degree murder and concealment of a body.

Bigsby had been set to go to trial in July on charges of child abuse and neglect that were unrelated to Codi's disappearance.

He is facing 24 counts of gross, wanton, reckless care for a child (felony), four counts of child abuse and neglect leading to serious injury (felony), and two counts of failure to seek medical attention for an injured/battered child (misdemeanor).

But, according to the commonwealth's motion, one of the primary witnesses in the case is one of Cory Bigsby's other children, who was 4 and 5 years old at the time of the alleged offense.

The motion asks Hampton Circuit Court to "noelle prosque" the charges, from the Latin "not wish to prosecute," but they could bring the charges up again at a later date.

Now 8 years old, the child is "undergoing intensive counseling and therapy as a result of the defendant's actions that led to these charges," the motion reads.

It also says the child is a sibling of Codi.

"Due to his age and serious nature of these charges, the commonwealth would like the opportunity for [the child] to continue his counseling and therapy before subjecting him to another jury trial to better protect his mental and emotional well-being," the motion reads.

Virginia appeals court upholds Cory Bigsby murder conviction

The Virginia Court of Appeals has upheld the murder conviction of Cory Bigsby, affirming a 45-year prison sentence for the killing of his 4-year-old son, Codi Bigsby, whose disappearance in Hampton in 2022 sparked a multi-state search.

In a published opinion issued December 30, the court ruled there was sufficient evidence for a jury to convict Bigsby of second-degree murder and concealment of a dead body, even though Codi’s remains have never been found. Judges also rejected Bigsby’s claims that prosecutors improperly struck Black jurors and that the trial court wrongly allowed several jurors to serve.

With the appeals court ruling, Bigsby’s convictions for killing and concealing the death of Codi Bigsby remain intact, and his 45-year sentence stands. As of trial, Codi’s body had still not been recovered.

Child skeletal remains found in Georgia not believed to be Codi Bigsby, Hampton Police say

You may have seen rumors circulating on social media that the skeletal remains of a child discovered last fall in Rockdale County, Georgia look similar to that of Codi Bigsby, the 4-year-old Hampton boy killed by his father in 2021 or 2022.

WTKR News 3 reached out to authorities in Georgia and Hampton police to investigate the claims.

Hampton Police told us that "at this time, there is no confirmed connection between that investigation and Codi Bigsby."

The Rockdale County Sheriff's Office sent News 3 the following statement:

"The Rockdale County Sheriff's Office is aware of the case involving Codi Bigsby. We are communicating with Hampton PD to determine if there is a connection. Beyond that, we are unable to release any other information due to this being an ongoing and active investigation."

That headline is kind of wrong, the statement by Rockdale doesn't say at all that it's not Codi. I didn't read the link but would think their statement says otherwise, they don't seem to know yet, not sure why.

ITA that he did NOT say it wasn't Codi, he said they didn't know and were investigating.
Their age estimate is a bit older than Codi though.

RCSO seeks public’s help in identifying remains of child

Upon arrival, deputies confirmed the remains were skeletal and human. Investigators later determined the remains belong to a child believed to be between 6 and 7 years old and no older than 8, according to the sheriff’s office.

Authorities said a forensic facial approximation was completed in an effort to help identify the child.

The circumstances surrounding the child’s death remain under investigation, and no cause of death has been released at this time.
