Bernard Madoff says he is dying and is asking a judge for compassionate release from prison, where he is serving 150 years for orchestrating the largest Ponzi scheme in history, according to a Wednesday federal court filing.

Madoff, 81, has terminal kidney failure and a life expectancy of less than 18 months. When the court sentenced him, “it was clear that Madoff’s 150-year prison sentence was symbolic for three reasons: retribution, deterrence, and for the victims,” the court filing states. “This Court must now consider whether keeping Madoff incarcerated … is truly in furtherance of statutory sentencing goals and our society’s value and understanding of compassion.”

Madoff said in the request for compassionate release that he “does not dispute the severity of his crimes.”


IMO- stay in jail

The Facebook message arrived Sunday night. Jesse McFadden wrote that he was doing well at a marketing job and had made a great life, just “like I promised I would do with you.”

“Now it’s all gone,” he said in his message, which he sent with a photo of himself staring directly at the camera. “I told you I wouldn’t go back.”

“This is all on you for continuing this.”

The woman, Kaitlyn Babb, 23, provided the message to NBC News. It was sent from an account with the name "Holly Days," and the police chief leading the investigation just outside Henryetta, Okla., Joe Prentice, said he had reviewed the message and wasn't sure if it was sent before or after the killings.

LA County District Attorney George Gascon is reviewing a petition for a new trial in connection with the 1989 murder in Beverly Hills of Jose and Kitty Menendez by their sons Lyle and Erik, filed by the brothers’ lawyers this week citing new evidence.

“We have received the habeas petition in the Menendez matter and it’s currently under review,” Gascon’s spokesman Greg Risling said in a statement.

This is the first response from Gascon’s office to the petition, filed in L.A. Superior Court by attorneys, Mark Geragos (co-owner of Engine Vision Media, parent company of Los Angeles) and Cliff Gardner.

According to the writ, “newly discovered evidence directly supports the defense presented at trial and just as directly undercuts the state’s case against petitioner.” The attorneys argue that the new evidence could have led to a different outcome at trial had it been presented in the brothers’ defense.

Yeah....Riiiight. O.K. The one armed man did it. California sure is coddling these killers now. Scott Peterson verdict overturned. I see that as total bulls**t! New evidence. Really?. He was the only one with motive. His actions gave him away too. Just mannerisms.

Tory Lanez has been denied a new trial after being convicted in December 2022 of shooting Megan Thee Stallion, as reported by FOX 11 Los Angeles, KTLA and KABC. The 30-year-old rapper, who is currently in jail, now awaits sentencing.

His request for a new trial was rejected by Los Angeles Superior Court Judge David Herriford on Tuesday, per the outlets. One day prior, Lanez's attorney Jose Baez argued that his being found guilty of assault with a semiautomatic firearm, carrying a loaded, unregistered firearm in a vehicle and discharging a firearm with gross negligence was due to procedural errors, prosecutorial misconduct, discovery violations and ineffective counsel.

Upon denying the motion, FOX 11 reported that Herriford said, "The court finds no error, prosecutorial misconduct or newly discovered evidence."

The request for a new trial was filed last month, with Baez and Barhoma claiming that the use of an Instagram post and photo of the rapper's gun tattoo as evidence was prejudicial to Lanez, according to the outlet.

After the motion was denied, Lanez reportedly told Herriford, "Your honor, please don't ruin my life."

The rapper's sentencing date has not yet been set. He faces up to 22 years and eight months in prison and has been in jail since the verdict was read in December.

Also in April, Lanez posted on Instagram to share a statement directed toward Los Angeles County District Attorney George Gascón, claiming he was "wrongfully convicted of a crime I did not commit."

He said in an audio recording also shared to Instagram at the time, "Mr. Gascón, I come to you today as a wrongfully convicted Black man, not asking for sympathy, nor compassion, but for you to simply do what is fair and right in the laws of California, and most importantly in the eyes of God."

So was he the attorney at the time of conviction AND claiming ineffective counsel?

I don't know if this is what Baez applied for or not. Could be that a licensed California attorney is also part of the defense team??

Recall: He also represented Aaron Hernandez in Massachusetts, Harvey Weinstein in New York, etc. if my memory serves me correctly. :D

Per FOX 11, Lanez's lawyer also said his former attorney George Mgdesyan "failed" the rapper due to lack of preparation time and claimed the original 10-day trial "was a jumbled, bungled mess."

Wow.

I was absolutely obsessed with this case back in the day. I lived it and breathed it quite honestly and searched constantly for anything I could find on it, joined a blog, etc.

He only got 28 years for the murder of Flores? Unreal. Maybe I knew that, I can't recall. I don't think so though, I think I thought he was put away for life...

No idea how this would work but hopefully whatever sentence this results in here I would hope can be served consecutively to keep this evil thug in prison for the rest of his natural life or as close to it as possible.

I pray the Holloways one day get their daughter back and get answers but I sadly don't think it likely but one never knows.

It is good news that they will see some justice here on U.S. soil although the thought that that creep is on U.S. soil is not a welcome one.
