Adoptive parents of 2 missing toddlers plead not guilty to murder charges​

The adoptive parents of two missing California toddlers pleaded not guilty Thursday to murder charges, a day after a prosecutor alleged that the couple killed the boys months before they were reported missing.

Trezell West, 35, and Jacqueline West, 32, were arraigned in Kern County Superior Court in Bakersfield on two counts of second-degree murder, two felony counts of child abuse and a misdemeanor charge of making a false report of an emergency.

They both pleaded not guilty to all charges.

"There is clear and convincing evidence that both defendants are a significant and substantial risk to public safety," Judge Chad Louie said during the arraignment and ordered that the couple be held without bail at the Kern County Jail.

Attorneys for the couple left the court without commenting to reporters.

Louie granted a motion from prosecutors to seal a probable cause declaration in the case as well as all offense reports.

The judge also scheduled a March 8 hearing on a request from prosecutors for a gag order in the case. Louie set a tentative trial date for May 23.
 
Haven't watched it all yet but Linda on today's hearings, etc. One thing she mentioned is that LE received info a week after the children were missing and that is how Bakersfield become involved... I don't think Bakersfield took over immediately if I recall but it probably then had investigation going on in Bakersfield as well and over time what was determined from that is why jursidiction changed. My guess is that is the last time they would verify anyone saw the children OR something happened on a certain day that was significant AND the last time they were seen.

Anyhow, it is less than 6 minutes.

 
Oh Lord, it says they also induced others to participate--from a position of leadership and dominance of others to participate in the crime... I can only think they had the other children doing something to these children along with them?? It has both of them in the indictments as doing this and i can only wonder why we didn't hear about her arrest as soon as his.

Great violence, threat of great bodily harm, a high degree of cruelty, viciousness or callousness. The two kids were particular vulnerable as described in a certain law, if I get time I may try to catch it again and look up the specific law(s).
 
Yep, confirmed now, induced a minor to commit the crime or assist. Threatened witnesses, unlawfully dissuaded or prevented witnesses from testifying. Suborned perjury and illegally interfered with the judicial process.

I can't say I'm surprised. Instincts on these two were right on.
 
Wow. These poor babies.

I'd really like to know how they threatened witnesses and with what... Their own and adopted children they would have that power over but I get the sense there are more than children as to witnesses. Hard to say though.

Considering much is sealed this was still a lot of info...

I wonder what the agency who placed them and let them be adopted rather quickly has to say now...

All is proving true on what most thought (myself included) and my next bet of course is they continued to collection money and benefits for these boys...
 
From what I’m reading and what I saw on Linda’s show, it really does seem like the other children were involved in covering up what happened to these boys. Thankfully, it doesn’t sound like they were willing participants.

I don't know. To me it sounds like more than just the cover-up. I don't mean they were willing or not "induced" or expected to do something by an authority figure but I just don't get the sense it is only the cover-up...

I would have to guess since they treated these children horribly it is likely the other two adopted children weren't probably treated all that great either...

Charles Pettus, the biological Father of four-year-old Orrin, birth name Cincere and three-year-old Orson, birth name Classic, reacting to the boys' adoptive parents Trezell and Jacqueline West being arrested and indicted this week.

"It's a good thing about the situation that's going on right now of how they got caught and everything and we started to find more information about the boys and anything else I keep it positive, stay with my family," Pettus, said.

The family says the information that surfaced from the District Attorney this week is what they suspected all along.

They appreciate all the support from the people of Bakersfield and California city.



Pettus's Attorney Antonio Castillo says what happens in the case of the District Attorney's office against Trezell and Jacqueline West has major implications to Pettus's lawsuit against Kern County.

"It's significant obviously because, throughout the criminal prosecution and that process, evidence is going to come into court and is going to come into play that is going to show what it is that the Wests did," Antonio Castillo, Chief Trial Counsel of DRE APC, said.

Pettus is suing Kern County for Child Protective Services wrongfully removing the boys out of his home and putting them into the home of Trezell and Jacquline.

When Cincere, Orrin was three months old he fractured his femur. His parents took him to the hospital. The authorities were notified. They found no sign of abuse. Castillo says after Classic, Orson was born CPS removed both boys from their parents, 11 days after Classic was born.

"It just doesn't make sense, why the two boys were taken away and then still two of their children, their siblings were still left in the household," Castillo, said. "Either a house is unsafe or it's not. Either parents are unfit or their not. You don't just take two away. It doesn't make any sense."

I don't know and don't think anyone does the entire story of the history of the bio parents and the children but I do know they wanted them back and that the adoption thing and more was highly questionable, fast and so was the fact family members weren't fostering them...

That agency definitely needs to be looked at and held responsible or explain it. More power to him.

No kidding. I really think they thought they were that smart, and they clearly think they have power and rule or are untouchable. Why, I don't know. A couple of people who unlikely did much of anything ever in their lives. Power over children I guess and claiming connections to people who are a bit "bigger"...

Just sleazy.

I'm sorry but there are so many cases like this and people still don't get there is profit and free living almost with some adoptions and fostering these days. That brings people who care less about the kids but want the benefits and money. Shove the kids in a cage and collect. It is a horrible idea and way to do things. There is also profit to states the more they adopt out each year/agencies. From the feds. So there is an incentive to beat last year's figure, fast and adopt out as many as they can.

These two are a CLASSIC example. And I need to learn to use these boys' REAL names. Classic and Cincere.

“Statements that have been used by the Kern County District Attorney in her press conference tend to invoke a tidal wave of emotion toward finding guilt, whether substantiated or not, and this will taint a local jury pool and could deny our clients a chance at a fair trial,” said Timothy Hennessy, attorney for Trezell West. “It’s odd that the office held their press conference, made a series of comments which both mis-and-disinformed the public then the following day came and requested a gag order to stop the defense from having an ability to make similar comments.

“This action is disingenuous but may also cause a change of venue in the future. This is an election year and this case is serving as a compass to guide the DA to her path of reelection. However, now is the time when the misleading and theater end and the constitutional protections begin.”

The phrasing used by Zimmer — saying the grand jury was “convinced” and it “believed” — is not a legal standard used at trial, Hennessy said. He said the standard of proof at grand jury proceedings is much lower than the standard of being found guilty beyond a reasonable doubt required at trial.

Hennessy also pointed out defense counsel and the accused are not present during grand jury proceedings and have no opportunity to cross-examine witnesses or present evidence.

Zimmer’s comments, Hennessy said, make it seem like the case is a “done deal,” but the Wests are innocent until proven guilty.

Reached afterward, Zimmer said the DA’s press conference was held to address questions by the media given the high level of public interest. She said her office will have no further comment until a verdict has been reached.

Trial is scheduled for May.

While it's obvious the grand jury agreed and believed, they sent it to go to trial after all. I still kind of agree with the defense attorney. It doesn't need to be said and saying it out loud does seem a little prejudicial.
 
Even though a grand jury bypasses a preliminary, I'll believe a May trial when I see it. I seriously doubt any trial will go off that fast especially when this special couple is all lawyered up. As their attorneys said, now all the whatever, I guess media, publicity, etc. ends and their rights start being protected. Okayyyy. And we know what starts then, the sh*tshow of things thrown by the defense...

I actually watched the entire thing with the defense attorneys, just can't remember the words so I'm poorly paraphrasing. They talk like all these games will end and now it will be serious court, yeah right. If there are games that go on it will now be games by the defense now that charges have been brought... They will throw as much sh*t, motions, etc. as all defense attorneys do to just muddy all and make the entire thing not about these boys but about how their clients are being persecuted.

I know nothing of these attorneys but oh boy did they appear fast and speak out. Fits right in with this couple...

Have Jamal and grandma had anything to say...? Unless it is misunderstood both claimed to have seen these children after the date LE is saying they were dead... More charges should be coming if that's the case no matter who J is...
 
I watched Linda‘s video about this case last night and she did a recap of the original interview. Just watching them it makes it impossible for me to believe that they didn’t have something to do with those kids going missing. Anybody that watches that interview has got to know that they are lying.

I think that interview is why the case blew up huge no doubt and then their unbelievable story and from their nothing added up at all. But that interview was definitely a downfall... Imo.

With that, a gag was set, prohibiting investigators and law enforcements from publicly speaking about the case.

This case went nuts. I can see the reason for it IF the reason is to ensure there are limited appeals by doing it smart without publicity, internet, etc. BUT if the reason is to protect the wrong people in the guise of a real reason to do that well then I don't agree....

LIKE what is being done or answered on HOW these kids were adopted by this couple and CPS the choice and fast tracking it seems... People have been clamoring for that answer throughout...

I'm a believer in general in that all should be open record in adult court (not necessarily minors) and we sure don't want appeals because of too much publicity, etc. BUT imo that is IF that is the real reason... It is a great way to cover up as well... I applaud the parent(s) for filing suit on placement, adoption, and how it came to be, etc.

I'm watching Court TV and the judge has issued an order that the parents aren't to have any contact with their other children. It seems the judge is worried that the parents may try to pressure the kids into lying for them.
I saw just a blip yesterday or the day before that the parents had requested visitation with their children and people were reacting of finding it hard to believe they still had their children to request visitation. The understanding was they were taken away some time ago long prior to arrest. Not sure on the facts on that and maybe they had been reunited no idea...

So do you know, I mean did they have them and now that in jail want to see their children who they had custody of or did they maybe have supervised visitation and want to continue it from jail...?

I didn't see enough to be sure or recall the situation prior...

It has long been speculated that the other children were of course questioned as to the last time they recall these boys being around. And the charges seem to indicate quite possibly that adults encouraged minors to participate in abuse (seem to indicate/speculation)...
