Luis Rivera, one of two convicted hitmen in the
murder of
FSU Professor Dan Markel, will soon be released from federal prison.
Bureau of Prisons records show Rivera is currently being held in Marianna FCI and is slated to be released later this month on June 30. Prosecutor Georgia Cappleman says Rivera will be immediately transferred to a state prison.
“He still has a state sentence to serve so he’ll go to a state facility to serve the remainder of that sentence,” Cappleman said. “I think he has seven, seven and a half more years, but of course, he’ll get gain time, so that’s at the discretion of the Department of Corrections.”
Rivera entered a plea soon after his arrest in Markel’s murder. In October 2016,
Rivera pleaded no contest to second-degree murder and was sentenced to 19 years in prison. At the time of his arrest, Rivera was already serving a 12-year federal prison sentence on unrelated charges. Those sentences have been running concurrently.
Rivera’s plea deal included a promise to
truthfully testify against the other co-defendants in Dan Markel’s murder. That includes testifying in the upcoming trial of Donna Adelson.
“He entered a plea agreement that required full and complete cooperation,” Collins said. “Of course, when we entered that plea deal, I don’t think anyone had any idea how many trials that would involve potentially testifying in.”
Rivera has taken the witness stand to testify in the trials of fellow hitman Sigfredo Garcia, the
convicted go-between
Katherine Magbanua, and
Markel’s former brother-in-law
Charlie Adelson who was convicted of coordinating the murder plot. All three are currently
serving life sentences.
“He’s provided consistent testimony about the murder itself,” Cappleman said. “I think it’s been essential to all the proceedings we’ve had so far.”
Rivera is on the state witness list for
Donna Adelson’s trial which is
set to begin on August 19.
