Scott Peterson's death sentence in murder of pregnant wife overturned by California Supreme Court
Laci Peterson and their unborn son, Conner, were killed over 15 years ago



The California Supreme Court on Monday overturned the death penalty sentence for Scott Peterson, convicted in the Christmas Eve murder of his pregnant wife, Laci, and their unborn son, Conner.

The court's decision came more than 15 years after Laci, a Modesto, Calif., school teacher, was killed. Investigators said Peterson dumped his wife's body from his fishing boat into the San Francisco Bay in 2002. The bodies of Laci and Conner surfaced months later.

While the murder conviction against Peterson stayed in place, the court ordered a new penalty phase trial.


"Peterson contends his trial was flawed for multiple reasons, beginning with the unusual amount of pretrial publicity that surrounded the case," the court found. "We reject Peterson's claim that he received an unfair trial as to guilt and thus affirm his convictions for murder."

However, the court ruled the trial judge in Peterson's case "made a series of clear and significant errors in jury selection that, under long-standing United States Supreme Court precedent, undermined Peterson's right to an impartial jury at the penalty phase."

The court also agreed that potential jurors improperly were dismissed from the jury pool after saying they personally disagreed with the death penalty but would be willing to impose it per California law.

Peterson, now 47, also claimed on appeal that he couldn't get a fair trial because of the massive publicity that surrounded his case, even though his trial was held nearly 90 miles away from his Central Valley home of Modesto to San Mateo County, south of San Francisco.

Stanislaus County District Attorney Birgit Fladager did not immediately say if she would seek the death penalty again.

Peterson has been housed on San Quentin State Prison's death row since he was sentenced to death by lethal injection in 2005.

Peterson's case grabbed national headlines and intense pressure was put on investigators to find her killer. They chased nearly 10,000 tips and considered parolees and convicted sex offenders as possible suspects.

On Dec. 24, 2002, Peterson called his mother-in-law, Sharon Rocha, in the early evening to ask if Laci was with her. He told Rocha he had returned from a day of fishing and when he got home, Laci's car was in the driveway and their dog was in the backyard with his leash on.


The call to Rocha around 5:15 p.m. would set off a chain of events that would move an entire community, which jumped into action to find the missing mom to be. As the days and weeks went on, the search for Laci, who was 8 1/2 months pregnant when she disappeared, became more desperate.

Peterson claimed she was home the morning he left for his fishing trip in the San Francisco Bay and that was the last time he saw her.



Laci's family went on television, pleading for her safe return and for any information to help find her.

"Please bring my daughter home," Rocha asked the public in one news conference.

Attention soon turned to Peterson who has maintained he had nothing to do with Laci's disappearance.

One month after Laci's disappearance, police revealed her husband was living a double life, having an affair with a massage therapist who was living in Fresno by the name of Amber Frey.

Frey, a single mother, went to police once she became aware that the man she thought was her boyfriend was quickly becoming a prime suspect in a nationally televised case.

She eventually would go on to wear a wire and helped police record her conversations with Peterson, which would play a key role in the trial.


On April 13, 2003, the body of a baby boy was discovered along the shore of San Francisco Bay. The next day, the body of an adult female wearing maternity clothes was found nearby. The bodies were positively identified as those of Laci and her unborn son Conner.

Peterson was arrested in San Diego just days after the bodies were discovered.


He had dyed his hair blonde, grown a goatee and had many items in his car which led investigators to believe he may have been ready to run.

The double murder trial would take more than a year to begin, but at the end Scott Peterson was found guilty of first-degree murder for killing his wife, and second-degree murder for killing Conner.

Peterson, who pleaded not guilty, has always maintained his innocence.

Okay, help me out. MMO? Maybe I should know but drawing a blank. Yes the burglar thing is ridiculous. This is the kind of thing they try to claim exclupatory that is pushing things too far these days. I'm sure they waited with Laci dead in their van to see what Scott would do. They followed him to the bay. The fortunately had some cement with because they couldn't have known he would go fishing and quickly made an anchor to weight her down. They stole a boat and went out on the water after Scott did, and dumped her...

So fortunate too that Scott never saw them when they did all this near right where he was and didn't witness his wife being dumped by burglars in a white van.

DUHHHHHHHHHHHHHHHHHH! Do they have any judges there with brain cells? Seriously. SMFH.

He himself must be thinking how absolutely dumb the systems and judges are AND the LA Innocence Project for that matter...
 

Scott Peterson murder case back in the news – could new evidence set him free?​


It’s been more than 20 years since Scott Peterson was sentenced to death for the murder of his pregnant wife Laci in suburban California. For many, the case was considered open and shut.

Then, in late April, the Los Angeles Innocence Project (LAIP) made a seemingly bombshell announcement.

The non-profit declared in a court filing that after a year-long investigation it had uncovered new evidence that “eviscerates” the prosecution’s theory of what occurred, and proves Peterson’s innocence.

“This new evidence undermines the prosecution’s entire circumstantial case against Petitioner, and shows that the jury relied on false evidence, including false scientific evidence, to convict him,” the organization, which provides pro bono legal services to people it believes have been wrongfully convicted, stated in a lengthy petition filed to a state appeals court.


The LAIP presents new evidence showing a home across the street from the Petersons was burgled the day of Laci’s disappearance, and that a witness reportedly heard a conversation between the burglars that Laci saw them and confronted them. The organization also says it has obtained new “sworn statements” from witnesses who reported seeing Laci in the neighborhood after prosecutors claim Scott killed her.

It also argues it has uncovered new evidence linking the burglars to a van that was set on a fire nearby and had a mattress inside with “apparent bloodstains”. The filing states the prosecution suppressed evidence of the police investigation into that incident and that it has not been subjected to more “precise DNA testing” to establish a link to Laci’s case.

As part of their investigation, the LAIP said it interviewed a retired Los Angeles police department lieutenant and police practices expert who reviewed police reports in the case and concluded that the Modesto police department investigation was disorganized and did not adhere to standard police procedures.

A key argument from last month’s filing emphasizes that new research and methods to determine fetal growth indicate that the Petersons’ unborn child was older than the prosecution’s expert witness, Dr Greggory DeVore, said – meaning Laci was killed days after the prosecution claimed.

“New evidence by Dr Doubilet shows that recent medical research published in peer-reviewed medical journals establishes that Laci and Conner were not killed until days after Laci was reported missing, at a time Petitioner could not possibly have been responsible for their deaths,” the filing states.

“These new scientific research and longitudinal studies all show that Dr DeVore’s opinion – which was based on a study published in 1984, when fetal biometry research was in its infancy – was wrong.”

Paula M Mitchell, the director of the Los Angeles Innocence Project, argued in the petition that the prosecution’s case was entirely circumstantial, and that it was highly likely the jury would not have reached a guilty verdict if they had heard the evidence laid out in the petition.

“In my opinion, once the police locked on to Mr Peterson as the prime suspect, they had no interest in finding evidence showing that someone other than Scott may have abducted Laci Peterson because that evidence did not fit with their working theory of the case,” Mitchell wrote.


The re-examination of the case has, perhaps unsurprisingly, proved controversial. After the news broke, the famed New York-based Innocence Project made a statement noting the LAIP is “wholly independent” from its organization.

Neama Rahmani, the president of West Coast Trial Lawyers and a former federal prosecutor, said he was surprised in some ways that the LAIP decided to work with Peterson. “They’ve done good work,” he said. “There’s just so much evidence [against Peterson].”
 
Smh. Sure wish @Mel70 was around, see new posts on some of these not as busy threads that she was the last or near to to post in some of them.

I'd heard some of this before, a bit more now as they have to try to turn over many a thing but so then sure the burglars then put a recording device on Scott or held him or eavesdropped or followed til they knew he was going fishing exactly where the bodies were found. Or maybe he was buddies with them... Uh-huh. Just my opinion on the article and all of it.

Interesting that other IPs denied an attachment to the LAIP one. I've thought little of them for a long time but I can't remember exactly what started that opinion, don't think it was Peterson at that point though, but think even less now of course.

As to the expert and the "change" in time periods as to how old the baby was and so on, there is almost never a trial you can't find dueling experts, at this point doesn't mean much to me.

I guess will see what happens, not a lot of faith in some of Cali but I don't know of a soul in this case that has ever thought him innocent. No one I know does that I can think of.
