Defendants' Rights - Have They Gone Too Far - Examples and Discussion

This comes up a lot in cases and I know I comment on it a lot and see it a lot as well both here and elsewhere on the internet.

I'll start with this simple one, there are rights all humans should have or be entitled to I guess, even most convicted criminals. Imo, one of those rights is NOT choosing your foods and meals. or thinking you have a right to complain or appeal to a judge or court over the fact you are not fed what you like.

They need to shut up. You get what you get. I think we should go back to the way things were. No menu, You get what you get. No 15 yrs of appeals. Did the victim get to appeal their murder?. Swift justice. You don't get T.V's and any magazines you want. Yes, They can even get porn magazines. No radio. 4 walls, A sink, Toilet and non violent and educational books.

I agree. What are basic needs, they should define them. Water, food. Health care (although many that are not in prison go without). I guess occasional fresh air. The ability to shower and stay clean. Shelter. Clothing. Toilet. Am I missing anything?

Appeals are getting ridiculous. I wonder if things are defined as to what can be appealed and what cannot or do they just throw all the sh*t against the wall to see what sticks?

One shower a week. It use to be that way. Fresh air, Nah, Their victim doesn't get it. Any miniscule thing needed is fine to sustain life. But treated like the POS you are!
 
A case in which they are dancing way too much to the tune of the defendant imo is Morphew. The man despite a murder charge is out on bail. That is fortunate enough and not all that common. But then he was also released on bail with, imo, little for restrictions and that I disagree with entirely.

There were problems with his ankle monitor, shouldn't have been. He was allowed to live near witnesses in the case, very close, I personally think that would be intimidating for them. His gf has been on the property illegally, he home where the victim was last seen and probably died. Charges dropped, no problem, no further restrictions on Barry because of it and no revoking of his bond.

But THEN he whines that he can't leave the county and his daughters live in another county. Granted. This is RIDICULOUS this pandering and allowing. I CANNOT see an appeal won on the basis of denying such a thing can you? So why allow it??

His daughters are adult and they DRIVE. What a bunch of b.s. They go on about winter roads and a mountain pass WELL come a different day, meet in between or more like it, WHO CARES? If daddy was not fortunate enough to be out on bond, they would be driving to the jail in his county just the same AND be limited on days and visiting hours or they WOULDN'T be able to see him but to drive so why WAS this granted? POOR BARRY. I'll bet you nothing stops these girls from driving where they want when they want and any parent of teens or twenty somethings knows it and quite often weather be dam*ed. Even so, it doesn't matter, this is a MURDER defendant and he is being pandered to.

And THEN his attorneys claim a hearing on Web-Ex was hacked and created a mess and the judge bought it although no one has heard one bit of a real basis for it NOR have they provided any evidence or direction about it, simply claimed it as far as I can tell.

It doesn't help that Colorado is by far too secret in their court proceedings. They cause and bring on themselves this type of doubt and MORE talk online, etc. because of it. It probably worked very well for them until recent years when light is being brought to what goes on there and some very high profile and questionable cases or unsolved ones.

I would like to see threads on sentencing (too light or released too early, etc.), laws and more but wasn't sure where to start so started with this topic. I don't like what is going on with sentencing in many places or cases either and/or how many times do we hear of someone that kills a child or adult that has a rap sheet that makes one wonder why they weren't already in prison for life or close to it...?

If anyone has ideas on how to separate them or do threads on such, I don't know about anyone else but I'd like to see some started or maybe they can combine under some heading, some interrelate.

And then there are laws or lack of them, etc. For instance I think an Amber Alert or something like it should be just about automatic with a minor and go out far and wide. And all states should have that. Like what they are doing in Idaho, because of the Vaughan case, at minimum.

The "affluenza" case comes to mind, too. Privileges of the wealthy.

I have heard of that one but am not familiar with it. I do think many cases "fit" that term though. Most definitely there is a difference in who one is in this world to this day in many systems and areas.

I'm assuming you mean the Couch case? I should read about that one if I get a chance.

I'm very curious to see what happens with Murdaugh too. Power, money and influence. However, isn't it interesting when it comes down to it, most of these high fallutin' types don't have money but stole it from someone else...? Or if they did have or come from money, they don't know how to handle it or live without it. And yet, and yet, and yet it continues and people brown nose right up to such types... Imo.

I just read it. How DISGUSTING. And the same judge sent a boy the same age away for 20 years who came from a sad childhood and not one with a case of affluenza. And that boy killed one person and had a low alcohol content and Couch KILLED four and had extreme alcohol content hours after the fact. What a load of B.S. And did he learn a thing? Of COURSE NOT.

I could go on but you already know the case. For others who don't, here it is.

And then the excuse of well maybe it is the trend towards rehabilitation for younger offenders, etc. and it says the judge was know for that well then WHY DIDN'T he go reduced the sentence of the boy who got 20 years??

What a sick world that this goes on still. LIght is being shown a whole lot more these days though...
