This is one of those child cases that are hard to read about. However, for some reason it is not getting much MSM coverage and little from Youtubers as well, I am unsure why since it certainly has, sadly, the elements to make it major news. It is not a new case but again, it is not getting a whole lot of coverage.

This article today is not the start of the case by any means. It does give a bit of a recap though. Read to the ending, the end says plenty about the two charged just with those remarks...

NYPD cop accused of beating his autistic eight-year-old son and letting him freeze to death quits the force ahead of disciplinary hearing so that he can keep his pension​

An NYPD transit cop charged with murder of his eight-year-old son has quit the force so that he can keep a portion of his pension.

Michael Valva, 41, has been charged in the murder of his 8-year-old son, Thomas, who was allegedly starved, beaten and locked outside their Long Island home. He died of hypoterhmia after sleeping in an unheated garage on a freezing night on January 17.

Valva and his fiancée, 42-year-old Angela Pollina, have been charged with second-degree murder in Thomas' death.

Valva was given custoday of Thomas and his brother in September 2017 despite desperate pleas from Thomas' biological mother, Justyna Zubko-Valva, and concerns from school officials that they were being abused.

While Valva is awaiting his trial next year, he has made the decision to resign from the NYPD, rather than face disciplinary action from the police force.

John LoTurco, Michael Valva's lawyer, did this so he can protect what was already in his pension, the New York Daily News reports.

'The NYPD offered him a resignation without a disciplinary hearing, and that allowed him not to admit any culpability and just resign, allowed him to keep his pension,' LoTurco said. 'But in exchange, there's no salary going forward.'

Resigning will also allow Valva to retain his benefits for the foreseeable future.


Authorities were dispatched to the home where Thomas had been living at about 9.40am on January 17 after his father said the boy had fallen in the driveway and lost consciousness while running for the school bus.

Responding officers found Valva performing CPR on Thomas in the basement.

The little boy was rushed to Long Island Community Hospital where he was pronounced dead.

He was allegedly forced to sleep in the garage the night before, despite it being 19F outside, with no blankets.

Thomas' cause of death was determined to be hypothermia.

According to police, cameras and microphones that had been set up in Mike Valva's home captured audio of him and Angela taunting Thomas as he froze to death.

The audio files allegedly recorded the couple discussing the fact that Thomas was suffering from hypothermia, had been washed with cold water, couldn't walk and was 'face-planting' on the concrete.

They laughed as they said 'he's hypothermic' and that he had 'face-planted' the floor.

Pollina remarked: 'You know why he's falling?'.

Valva replied: 'Because he's cold.... boo f*****g hoo'.

Thomas' death has since prompted an investigation into the social services department and how it dealt with abuse allegations against the couple and the children who lived with them.

A separate task force will examine how the department handles cases of children with developmental disabilities.

Following his death, Thomas' brothers were placed in the custody of their mother.

Pollina's daughters were placed in the custody of their biological fathers.

The video above is worth watching and the guy has several on this case. It does start out with a lot of hellos to his followers, a technical thing or two, then he loses the sound for a minute but after that it flows. The further in and the ending are particularly noteworthy. This mother begged, begged, begged for help for her children to any agency she could, in court, to any reporter she could come up with, even to the president and this Youtuber showed some of her Twitter posts doing this. He is a retired NYC officer himself and yet he is not shy about calling this monster out and stating how the system failed the mother and the children and not just one agency. He also remarks on how little coverage this case is getting and wonders why.

He also goes into detail about the pension and how it works and states that some of the comments out there and articles have it wrong....

He plays a bit of a clip of the three boys, one runs from his father to his mother and the other two the dad hangs onto and one in particular is fighting his dad to get loose from him, this tiny boy with this big man. It is disturbing. She had video of this and what they were saying to the boys which was they had to hate their mother basically or deal with wrath. The schools documented much including weight loss once the dad had custody and more, it too was ignored.

Apparently the courts and agencies ignored it all. Proof positive even. I believe she had no money for an attorney and did not know which way to turn but she tried everywhere, repeatedly.

I don't know the deal but it shocks me that this man and the evil witch he was with apparently felt invincible and untouchable in that recordings were there and it was almost blatant, and outright public even at the school. Imo.

I hope we can help this case get some attention, at least here. The Youtuber asked that it be shared on social media and more. Well, I don't do much if any social media but thought I would make a thread here. If anyone here is on social media and shares such things, please share the case and updates, etc.

Also, interestingly, if I remember correctly, the father wants his case split from the stepmom. Actually, I can't recall if they are married but anyway, I wonder if he thinks he can pin it all on her. There is plenty that I have read that shows they were BOTH very into doing this to these boys...

The paperwork asks a judge to throw out all evidence - video, recordings and statements - obtained in the search.

“I verbally requested that the police department leave my home by specifically asking them to please leave, yet my request was ignored,” Valva said in the affidavit, according to the newspaper.


The motion filed Wednesday also seeks to sever Valva’s prosecution from his co-defendant and fiancee Angela Pollina, who has also pleaded not guilty to second-degree murder and child endangerment charges in Thomas’ death.

This case is so atrocious. The mother looked for help for years upon years. It is really interesting daddy wants to sever charges from "stepmom" now (not married) as they were both despicable.

Hopefully there is no basis to throw this out. The couple I believe are the ones that called for assistance to report what happened (falsely)... The circumstances then discovered I would think and hope allowed the further actions.

‘We need to do better:’ Death of Thomas Valva, who died after NYPD cop dad forced him to spend night in freezing garage, sparks CPS reform​

After the death of an 8-year-old boy whose mother had repeatedly expressed concerns about her son’s well-being in his father’s care, Child Protective Services in Suffolk County, New York, will undergo systemic changes with the aim of preventing further tragedies like the death of Thomas Valva.

This week, Child Protective Services officials in Suffolk County told Newsday that they are implementing significant changes to their protocols in response to Thomas Valva’s preventable death. The agency is reportedly retraining case workers and making efforts to reduce case loads, while increasing caseworker supervision. In addition, case workers are being encouraged to solicit the observations of school teachers, coaches, non-custodial parents, and other people outside of the child’s primary residence.

“It really has given an opportunity for everyone to say, we as a county need to come together to do better by our children,” Sandra Davidson, chief deputy commissioner of social services, told Newsday. “It really has been a great experience working with everyone to address the gap.”

But Zubko-Valva’s attorney reportedly said the measures being taken are too little, too late.
 

Suffolk legislative committee to sue for documents in Thomas Valva case​


A Suffolk County legislative panel investigating the death of 8-year-old Thomas Valva voted Thursday to sue county Social Services Commissioner Frances Pierre to obtain records in the alleged abuse case because the department has not complied with a subpoena for the material.

The three-member committee directed its counsel, Lawrence Jay Braunstein, to file an Article 78 proceeding in state Supreme Court to direct Pierre to comply with the subpoena the panel issued last month.

The social services department has provided some documents, legislative Presiding Officer Robert Calarco (D-Patchogue) said. They include records concerning Child Protective Services caseworkers who investigated complaints against the Valva family, and the department’s corrective action plan following a state review,

But Pierre has refused to provide documents directly related to the Valva case, citing an opinion by the county attorney that state law social services law prevents DSS from turning over the material.

"New York State Social Services Law does not allow County DSS to provide the records being requested to the County Legislature," Derek Poppe, a spokesman for Suffolk County Executive Steve Bellone, said in an email Thursday.

State law makes CPS files confidential in most instances.

A commissioner may release information if a child has died and disclosure would not go against the interests of other children in the household.

Release also can be made to law enforcement officers, district attorneys, judges or "any other state or local investigative agency," according to state law.

That law has been a "severe hindrance" to the legislature's investigation into the Valva case, Calarco said.

She is charged as well, it is a preliminary hearing and I don't find it odd at all that she was not on the stand, whether it was due to her choice or the prosecution's choice. Most preliminaries they may put up a detective and a doctor/coroner or some such and not all of the other witnesses and they don't try the case, all they have to do is give enough cause for charges and the case to proceed. Jmo.

From all I know of this case, both the father and his fiance were terribly physically, mentally and emotionally abusive and horrible to both Valva children. Their mother did everything possible to try to have this shown to no avail, I don't know anyone who has tried harder in any case we know of. Who knows why all the failures but daddy was a NY cop. Even so, judges failed, services failed, etc.

Newsday reports that the proceedings against Michael Valva and his ex-fiancée Angela Pollina may not start until January because of COVID-19 concerns.

A ruling on the matter should come in less than two weeks.

The woman tried everything (his mother) and it fell on deaf ears... The courts failed her, services failed her, no one believed her or cared apparently...

And it also emboldened daddy (cop) and his fiancee to do more and taunt the mother with the abuse and ways... Those two are EVIL.

I personally don't think there is any excuse for this any longer. They've had plenty of time (all states, courts, businesses, etc.) to figure out how to deal with Covid so the already very slow wheels of justice can roll along.

This was a heinous crime by the child's own father and nasty gf and they put both children through he77 and their mother and she turned everywhere for help and couldn't get any. NY owes her and this child!!!
 

ALERT CENTER: Federal judge allows part of lawsuit filed in Thomas Valva death to proceed​

News 12 Long Island has learned a federal judge has allowed parts of the $200 million lawsuit filed by the mother of 8-year-old Thomas Valva to proceed.

A federal judge says the lawsuit Thomas’ mother Justina filed has adequately alleged Suffolk County’s failure to train CPS employees and it violated her constitutional rights.

Justina is suing the county and several CPS employees.

Thomas died in 2020 after prosecutors say he was forced to sleep in a freezing outdoor garage by his father Michael and his then fiancée Angela Pollina.
Both are awaiting trial after being charged with murder.
